Legal Positivist

Legal Positivism is a political and legal philosophy that asserts the existence and validity of law is determined by social facts and human decisions, rather than by inherent moral principles or natural law. According to this ideology, laws are rules created by human authorities—such as legislatures or sovereigns—and their legitimacy comes from the processes and institutions that produce them, not from any higher ethical or metaphysical standard. Legal Positivists maintain that there is a clear distinction between what the law is and what the law ought to be, emphasizing that…   the content of law is separate from questions of morality or justice.

The roots of Legal Positivism can be traced back to the Enlightenment period, when thinkers began to challenge the idea that law was derived from divine or natural sources. In the nineteenth century, the ideology was most famously articulated by British philosopher Jeremy Bentham and his student John Austin. They argued that law is simply the command of the sovereign, backed by the threat of sanction, and that its authority comes from its source, not its content. Later, in the twentieth century, scholars such as H.L.A. Hart refined Legal Positivism by introducing the concept of the "rule of recognition," a social rule that identifies what counts as valid law within a particular legal system.

Throughout its history, Legal Positivism has been influential in shaping modern legal systems and the way law is taught and understood. It has provided a framework for analyzing the structure and function of legal institutions, and for distinguishing legal questions from moral or political debates. Critics of Legal Positivism argue that it can lead to the acceptance of unjust laws, since it separates law from morality, but its proponents contend that this separation is necessary for clarity and stability in legal systems.
